Assisted the exterior enclosure – precast erection subcontractor with inefficiency claims associated with the disorganized delivery of wall panels for the exterior of an office tower in Boston, MA. Developed a delay, inefficiency, and damages claim.

Adena Mansion and Gardens Renovations

Assisted a major surety company in the resumption and completion of a terminated general siteworks contractor for the historic site and gardens renovation of the Adena Mansion and Gardens in Ohio. Statused the extent of completion, owner payments, subcontractor payments, and material deliveries. Developed resumption and completion bid package. Monitored completion contractor on behalf of surety through completion.

Akron Zips Stadium

Assisted the general contractor in the development of a delay and damages claim for the construction of the University of Akron Ohio Zips Stadium. The matter was settled through negotiation and a change order.

Al-Bayt Stadium

Assisted the general contractor in the defense of a delay and damage claim from its MEP subcontractor on the Al Bayt Stadium in Al Khor, Qatar. Developed a rebuttal delay and damages claim against the MEP subcontractor for the MEP subcontractor’s delayed performance. Developed a schedule analysis, analyzed step-in work claims, and analyzed MEP subcontractor’s alleged extra work claims. The matter went to an international arbitration panel for dispute resolution.

Ashley Park Apartments

Dispute over alleged defective construction. Developed cost to remove and remediate defective construction. Analyzed and assigned responsible parties for the defects. The matter was resolved through negotiations and a change order.

Bernard Baruch Vertical Campus Project

Assisted a defaulted general contractor’s surety in the development of a delay and damages claim for the construction of the Bernard Baruch Vertical Campus project for The City University of New York (CUNY). Prepared a detailed schedule analysis, calculated delay and inefficiency damages, and assisted the curtainwall subcontractor in developing its delay and damages claim against CUNY. Presented findings in a detailed expert report and in a joint meeting. The matter was settled pre-trial through negotiation and a change order.

Charleston Midtown Hotels

Renovation of historical buildings into the Charleston Midtown Hyatt Place/Hyatt House Hotel, a new hotel, restaurant, and conference center. Assisted the electrical subcontractor in the development of a delay and damages claim against the general contractor. Developed a schedule analysis, damage calculations and expert report. Presented findings in private meetings. The matter was settled through negotiation and a change order.

Crittenden Court Apartment Building

Assisted general contractor in the development and monitoring of the project schedule for the new Crittenden Court Apartment building in Cleveland, Ohio.

CSU Campus Village Apartments

Assisted the general contractor in the development of a delay and damages claim for the construction of the Cleveland State University Student Campus Apartment Building located in Cleveland, Ohio. Developed a schedule analysis, damage calculations, and expert report. The matter was settled through negotiation and a change order.

East Tennessee State University Martin Center for the Arts

Assisted counsel for the architect to evaluate the estimated cost of construction to remove and then re-build defective construction resulting from defective design. Calculated the cost to remove and then replace building components associated with the defective design. Prepared expert report of findings. The matter was resolved through negotiations.

Firelands Medical Center

Assisted the steel erector in the development of a delay and damages claim for the construction of the Firelands Medical Center located in Sandusky, Ohio. Delays resulted from an out-of-sequence construction. Developed a schedule analysis to determine the effective delay to the work, prepared damage calculations, and prepared an expert report. The matter was settled through negotiation and a change order.

Flats East Bank Project

Assisted the structural concrete subcontractor in the development of a delay and damages claim for the construction of the Flats East Bank Project, a mixed-use apartment, office, and parking garage building located in Cleveland, Ohio. Analyzed the construction through a schedule analysis to determine effective delay resulting from unforeseen site conditions. The matter was resolved through negotiations and a change order.

Four Seasons Resort and Residences Napa Valley

Assisted the investors/developers to assess construction cost overruns associated with a terminated general contractor, correction of the terminated general contractor’s defective construction, and overall late completion of construction.

French Lick Casino

Assisted the general contractor in the development of a delay and damages claim for the construction of the French Lick Casino in Indiana. Analyzed the construction through a schedule analysis to determine effective delay resulting from unforeseen site conditions. The matter was resolved through negotiations and a change order.

HJ Heinz Lofts Apartment Construction

Assisted the general contractor in the development of a delay and damages claim for the re-construction/repurposing of the HJ Heinz building into loft apartments. Assisted the general contractor in the development of a delay and damages claim for the construction of the Independence High School in Independence, Ohio. Analyzed the construction through a schedule analysis to determine effective delay resulting from unforeseen site conditions. The claim was successfully resolved through negotiation and a change order.

Jefferson County Justice Facility

Assisted the electrical prime contractor in the development of a delay and damages claim against the county for the construction of the Jefferson County Justice Facility. Analyzed the overall construction through a schedule analysis to determine effective delay to the work, developed productivity and delay damages, and presented findings in an expert report. The matter was resolved through negotiations and a change order.

Assisted the county in the defense of delay and damage claims from the general prime contractor and the mechanical prime contractor and developed an affirmative claim against the architect for defective design. Assisted the county in pursuing delay damages against its design architect. Analyzed the overall construction through a schedule analysis to determine effective delay to the work, assigned responsibility for the delays, and presented findings in an expert report. The matter was heard in federal court through a jury trial and resulted in a favorable verdict for the county.

Kirkham Place Condominiums

Assisted the general contractor in the development of damage claims for added expense due to unanticipated water intrusion occurring from deteriorated masonry. The matter was resolved through negotiation and a change order.

National Underground Railroad Freedom Center

Assisted a major surety company in the resumption and completion of a defaulted mechanical subcontractor during the construction of the National Underground Railroad Museum in Cincinnati, Ohio. Statused the extent of completion, owner payments, subcontractor payments, and material deliveries. The surety opted to finance the subcontractor to complete its work.

Oakland Public Library

Disputes arose involving the general contractor over the quality and pace of the work. The general contractor was found to be in default, and the project was halted. Assisted the defaulted general contractor in the development of a delay and damages claim. Analyzed the overall construction through a schedule analysis to determine effective delay to the work, developed productivity and delay damages, and presented findings in an expert report and deposition. The matter was subsequently resolved through negotiation and a change order.

Oberlin Fire Station

Assisted the City of Oberlin, Ohio, in the defense of a general contractor’s delay and damages claim. Analyzed the overall construction through a schedule analysis to determine effective delay to the work, assigned responsible parties for delay, and presented findings in an expert report. The matter was resolved in private arbitration.

Ocean City US Coast Guard Station

Assisted the mechanical prime contractor in the development of a delay and damages claim for the construction of plumbing and mechanical systems at the South Lake Union Hotel in Seattle, Washington. The matter was successfully resolved shortly after mediation started through negotiation and a change order.

Bayport Container Terminal Land Development Preparation South of Port Road

Land development project including grading and drainage work for the Port of Houston in Houston, Texas. Analyzed general contractor’s claimed outstanding change orders. Performed a schedule analysis and evaluated the general contractor’s labor productivity using a measured mile analysis. Analyzed the validity of the general contractor’s change order requests. Prepared an expert report for mediation and assisted in the attorney’s preparation for mediation. The matter was resolved in mediation, resulting in a minimalized change order to the contract.

BNSF Railway CREATE Project

Assisted the general contractor in the development of delay and damage claims resulting from issues beyond the contractor’s control. Presented findings in arbitration. The matter was successfully resolved through the arbitrators’ decision.

City of Indianapolis 38th Street Improvements

Assisted the general contractor with documentation of changed conditions for the improvements and renovation of 38^th Street in Indianapolis. Analyzed effective delay resulting from the changed conditions for the general contractor’s presentation and negotiation of entitlement for time extension and added cost.

Fort Washington Way Contracts 5, 10, and 22A

Assisted a major surety company as the project overseer of the completion of a defaulted general contractor for the construction of three major bridge structures in Cincinnati, Ohio.  Statused the extent of completion and the construction schedule. Updated the surety weekly of project progress and status. Monitored completion contractor on behalf of surety through completion.

Prepared delay and damages claim on behalf of the contractor for delays and interferences beyond the contractor’s control. Contractor successfully negotiated a settlement prior to litigation.

Greater Cleveland Regional Transit Authority Healthline Bus Route Line

Assisted the general contractor in the development of a delay and damages claim for the construction of infrastructure work between downtown Cleveland and University Circle in Ohio. Greater Cleveland Regional Transit Authority Waterfront Light Rail Line

I-20 Widening Columbia

Assisted counsel in the defense of a general contractor’s claim for delay and damages against the design engineer for defective design. Analyzed the alleged design defect and analyzed the overall construction through a schedule analysis to determine effective delay and damages resulting from the alleged defect to the work. Assigned delay to responsible parties.

I-240 & Nonconnah Parkway Interchange

Assisted a major surety company in the resumption and completion of a terminated general contractor for the construction of Nonconnah Parkway at I-240 in Memphis, TN. I-490 West Approach

Provided construction inspection services for the Ohio Department of Transportation for the construction of the I-490 West approach in Cleveland, Ohio.

I-73 & Airport Parkway Interchange Greensboro

Assisted the site works subcontractor in the development of a delay and damages claim for the grading and drainage construction of I-73 at the airport in Greensboro, NC. The claim resulted from changed conditions by the general contractor to the dirtwork waste sites.

Indiana I-90 Toll Road

Assisted the general contractor with developing a delay and damages claim associated with changes to the work scope for the reconstruction and expansion of the Indiana Toll Road. Developed a schedule analysis, damage calculations, and expert report. The general contractor was able to successfully negotiate a mutually agreeable settlement with the Indiana Finance Authority.

Indianapolis International Airport

The project involved expansion of the airport’s taxiways. Assisted the general contractor in the development and presentation of delay and changed conditions claims to the earthworks operations, which resulted from owner changes to the access of work differing from the conditions expected during the bid. The matter was resolved through negotiation and a change order.

Indianapolis Downtown City Street Improvements

Assisted the general contractor in developing and monitoring the project schedule and documenting changed conditions for the improvement and renovation of several downtown city streets located in Indianapolis, Indiana. Analyzed effective delay resulting from the changed conditions for the general contractor’s presentation and negotiation of entitlement to a time extension and added cost.

INDOT US 6 Roadway Reconstruction

Assisted the general contractor in the development of delay and damage claims resulting from unforeseen conditions. Developed a schedule analysis, damage calculations, and report of findings. The matter was resolved through negotiation and a change order.

Keystone Parkway

Lansing Capital City Airport

Assisted a major surety in the resumption and completion of sitework at the Capital City Airport located in Lansing, Michigan. Long Island Railroad Third Track Expansion Floral Park to Hicksville

Assisted the general contractor in the development of changed work claims resulting from owner deviations from the project specifications. The owner required the contractor to provide and install building components different than those specified in the contract.

Assisted the general contractor in the development of delay and damage claims resulting from lack of access to portions of the work. The lack of access resulted from several different issues, such as the contractor’s inability to work within a certain distance of live train tracks, the contractor’s inability to perform work because the owner did not comply with specified track shut down times and the contractor’s inability to perform timely work because the owner did not provide adequate boundary survey pins. The contractor performed unanticipated historical survey boundary research and then performed a more extensive boundary site survey than expected.

Ludlow Avenue Bridge

Assisted the general contractor in the development of delay and damage claims resulting from a defective design pertaining to the survey and layout of the bridge, which was beyond the contractor’s control. Developed a schedule analysis, damage calculations, and expert report.

Manitoba CentrePort Canada Way

Assisted the general contractor with the assessment and determination of cost overruns associated with changes to the design of mechanically stabilized earth (MSE) walls. Developed damage calculations and an expert report. Contractor negotiated a settlement with the owner.

MassDOT I-93 Central Artery

Assisted several general contractors in the development of delay and damage claims for lack of access to portions of the work resulting from unforeseen/unknown underground utilities. The unforeseen conditions resulted in delay and productivity issues. Developed a schedule analysis, damage calculations, and expert report. The matters were resolved through several presentations and negotiations with MassDOT.

McDonough St. Bascule Bridge

Assisted the general contractor in the development of a delay and damages claim for the renovation of a historic bascule bridge in Joliet, Illinois. Developed a schedule analysis, damage calculations, and report of findings. The matter was resolved through negotiation and a change order.

Metra BNSF Railway Line Cicero Station

Assisted a major surety company in the resumption and completion of a terminated general contractor for the construction of the Cicero Station. Statused the extent of completion, owner payments, subcontractor payments, and material deliveries. Developed resumption and completion bid package. Monitored completion contractor on behalf of surety through completion.

Metropolitan Atlanta Rapid Transit Authority Train Control & SCADA

Assisted the owner (MARTA) in the defense of a contractor claim for delays and damages associated with the delayed completion of work. Developed a schedule analysis determining that the alleged delays were not critical delays and other contractor delays were determined to be critical instead. The owner was able to negotiate an amicable settlement with the contractor.

Miller Road at I-77

Assisted the general contractor in the development of delay and damage claims resulting from unforeseen conditions. Developed a schedule analysis, damage calculations, and report of findings. The matter was resolved through negotiation and a change order.

OTC over US 20 Lorain County

Provided construction inspection services for the Ohio Turnpike and Infrastructure Commission on the reconstruction and widening of a bridge over US Route 20 in Lorain, Ohio.

Ottawa Confederation Line – Light Rail Track and Tunnel Construction

Assisted the general contractor in the development of a schedule analysis to demonstrate the effective delay that a sinkhole caused to the critical path of construction. Developed a schedule analysis and expert report. The findings were presented in numerous meetings. The contractor and its counsel were able to resolve the matter through negotiations and a change order to the contract.

Ottawa Confederation Line – Vehicle Manufacturing

Assisted the general contractor in the assessment of a delay and damages claim from its vehicle manufacturer. A detailed critical path schedule analysis was performed to calculate the effective delay and parties responsible for delays encountered on the vehicle manufacturing. The findings were presented in arbitration.

Quigley Road Connector

Assisted the general contractor in the development of delay and damage claims resulting from unforeseen conditions. Developed a schedule analysis, damage calculations, and report of findings. The matter was resolved through negotiation and a change order.

Raw Water Intake System Improvements

Assisted a major surety in the evaluation of a defaulted contractor hired to install raw water intake pipelines to a water treatment plant.

Assisted the steel erection subcontractor in the development of a delay and damages claim resulting from changed conditions to the sequence of its work. The work was contracted to be performed overnight and was shifted to daytime hours. The daytime hours were affected by rush hour traffic and train traffic that would not have been encountered in the night shift. The claim was resolved through private arbitration.

Toronto 407E Extension

Assisted the general contractor in the assessment of delay resulting from changed conditions that were beyond the contractor’s control. Advised the contractor of the overall critical path of the project. Participated in attorney and company meetings regarding claim viability.

Traverse City Hammond-Keystone Connector

Assisted the general contractor in the development of delay and damage claims resulting from issues beyond the contractor’s control. Developed a schedule analysis, damage calculations, and expert report. The matter was resolved through negotiation and a change order.

US 422 East Extension

Assisted the general contractor in the development of delay and damage claims on the new construction of US 422 in Geauga County, Ohio, resulting from unforeseen conditions beyond the contractor’s control.
