Analyzed the owner’s actions and plans for developing a first-of-a-kind activated carbon plant. Evaluated the adequacy of the owner’s front end engineering designs (FEED) and other project development standard of care issues. Reviewed the need for pilot plant testing and the owner’s plans for incorporating the results into the FEED. Analyzed the validity and appropriateness of purchase orders for major equipment. Evaluated if the owner’s engineering and other development efforts were reasonable, necessary, and prudent in light of project challenges. Lastly, reviewed the owner’s contracting and risk sharing approaches with the contractors. Case settled favorably for the client.

Evaluated design, procurement, and construction issues and advised claim negotiation strategies regarding the construction of a $100-million air separation unit in Texas. Principle issues included design changes, schedule delays, labor overruns, labor productivity impacts, late equipment and material deliveries, bid errors, and force majeure impacts.

Evaluated various technical and project management issues associated with the upgrade of crude oil pumps, a control system, power generation facilities, and other systems at four (4) crude oil pumping stations. Analyzed various engineering and standard of care issues involving the engineering and construction of a chlor-alkali salt-to-bleach plant including schedule delays and increased costs associated with engineering changes, 3D CAD model changes, defective engineering, rework, and mismanagement. Reviewed and analyzed hundreds of piping and instrument diagrams (P&IDs) to evaluate the impact of changes, if any, on the project’s cost and schedule. Testified in arbitration, which led to a favorable settlement for the client.

Combined Cycle Power Plant Conversion, Domestic

Analyzed contractor claims for schedule delays and increased costs for the addition of a heat recovery steam generator (HRSG), steam turbine, air-cooled condenser (ACC), and other items to convert a simple-cycle gas turbine into a combined-cycle power generator. Issues included late and defective owner-furnished equipment, over-inspection, changes, late engineering drawings, acceleration, requests for information (RFIs), delays, and disruption. Assisted the client in negotiating a favorable settlement.

Served as consulting expert on the construction and conversion of an existing gas turbine to combined cycle operation. Evaluated damages to the combustion gas turbine due to contamination in the natural gas feeding the unit. Identified and evaluated contaminants in the natural gas coming from various pipelines and assessed the formation of iron oxides/black powder and the impact on the air intake and combustion gas turbine systems. Crude Oil and Natural Gas Processing Plant, International

ICC Arbitration – Analyzed over 50 alleged changes with a claimed value of over $1 billion to determine if they were valid contract changes. This required an engineering analysis to review piping and instrument diagrams (P&IDs), project specifications, equipment specifications, plot plans, heat and material balances (H&MBs), materials of construction, and other technical drawings and documents. Issues included impacts resulting from alleged owner changes, HAZOP changes, changes in feed gas composition, and equipment material supply changes. Quantified the cost of each alleged change and testified in Paris, France, regarding the quantum and validity of each alleged change.

Crude Oil Degassing Facility, Domestic

Evaluated contractor claims for additional compensation and a schedule extension for a crude oil degassing project at the Strategic Petroleum Reserve in Texas and Louisiana. Issues included design changes, differing site conditions, plant access, constructive changes to the contractor’s means and methods, defective plans and specifications, labor productivity, over-inspection, and site overhead and extension costs.

Crude Oil Pipeline Spill, International

Analyzed the maintenance and operation of a crude oil pipeline following a major oil spill and fire at a crude oil pumping station in Mexico. Evaluated pipeline design and operating pressures, as well as the integrity management systems in place to monitor pipeline systems.

Crude Oil, LPG, and Condensate Terminal, Domestic

Analyzed over 30 contractor claims to determine if the alleged changes were valid and to quantify all valid changes. Issues analyzed included piping design changes, incorrect material specifications, and engineering errors and omissions. Analyzed technical documentation including piping and instrument diagrams (P&IDs), plot plans, equipment specifications, project specifications, and other relevant project documentation.

Evaluated contractor claims for additional compensation on a cryogenic gas plant expansion project in Kentucky. Issues included scope changes, mismanagement issues, lack of material control, defective pipe spool fabrication, and the use of unskilled labor. Presented analysis to the client for claims negotiation and settlement purposes.

Provided proposal preparation and estimate support for the revamp of an existing ethylene cracking plant. Provided contract risk analysis and construction claims assistance.

Fertilizer Complex, International

Performed engineering and studies for energy audits and process optimizations for an African fertilizer complex.

Analyzed engineering changes and alleged errors, welding deficiencies, contractor management issues, and delays associated with the dismantling of an ammonia plant and its reconstruction at a new site, along with the associated offsites and utilities. Floating Production Storage and Offloading (FPSO) Topsides Module Fabrication, International

Evaluated cost increases and schedule delays relative to the fabrication of eight (8) topsides modules for a floating production, storage, and offloading (FPSO) vessel on an offshore Brazilian oil field development project. Issues included constructive changes to the structural steel drawings, late and defective engineering drawings, late equipment and material supply, acceleration, assessment of liquidated damages (LDs) for delay, and project extension costs. Presented analysis in an expert report for arbitration purposes.

Gas Pipeline Compressor Station Upgrade, International

Evaluated contractor claims relative to payment for unpaid change orders and contract work, and the increased costs due to loss of labor productivity and extended home office overhead costs. Issues included failure to coordinate the project, insufficient site supervision, late and defective material supply, and differing site conditions. Presented analysis to the client for claims negotiation and settlement purposes.

Gas Processing Plant, Domestic

Analyzed an owner’s management, scheduling, and costs for the engineering, procurement, and construction of a natural gas processing plant. Evaluated cost reporting and tracking, cost estimating, scheduling, engineering changes and omissions, and staffing. Opined on whether the project was prudently managed and in accordance with the standard of care. Prepared an expert report and testified at deposition and trial. The jury returned a verdict in favor of the client.

Evaluated scope change, schedule delay, cost overrun, termination, and other technical issues relative to the construction of four (4) cryogenic gas processing plants in Louisiana. Additionally, analyzed feed gas quality and composition and assessed operating problems due to the off- specification feed gas. Testified in numerous depositions and at trial.

Analyzed various risk allocation issues between the owner and contractor from the perspective of an EPC professional. Analyzed work for the construction of an LNG facility using a combination of reimbursable, lump sum, and unit rate work. Issued an expert report summarizing conclusions.

Analyzed ship logs and other documents for evidence of trash and debris, reviewed dredging operating data for purported similar dredging projects to assess expected levels of trash and debris, and reviewed maintenance and repair records and assessed if they were associated with trash and debris events. Analyzed construction claims and disputes regarding the mechanical construction work (HVAC plumbing utilities) for the construction of a new military command operations facility. Issues included schedule delays, defective design work, trade interference, and severe weather impacts.

Evaluated design and construction issues that resulted in increased costs for the construction of four (4) unaccompanied enlisted personnel housing (UEPH) buildings in Texas. This $46-plus- million project included three-story buildings designed to include over 900 beds for military personnel. Issues included unforeseeable material cost escalation, late supply of utilities, defective drawings and specifications, additional work, and acceleration.

Analyzed numerous issues including process hazard analysis (PHA) and hazard and operability (HAZOP) studies, flare and pressure relief systems, fire and gas detection systems, the location of control rooms, communication systems, cryogenic piping, NGL transfer pumps, condensate stabilizer systems, pressure safety valve (PSV) studies and calculations, fractionation system modifications, and other technical issues. Issued an expert report and testified at deposition regarding observations and conclusions.

Audited project costs to determine if the contractor invoices were properly supported and compliant with contract requirements and industry standards.
