Iron Ore Mining Plant, Brazil

Project advisory services for the owner in renegotiating a $1.5 billion USD civil works contract with a Brazilian contractor related to an 800 km pipeline for an iron ore mining plant.

Jos-A-Arz School Academy, Washington, DC

Performed damages analysis on behalf of the school authority related to a contractor’s termination for default due to performance issues. Estimated the repair costs of the various defective and deficient works and the fair valuation to complete the remaining contract work.

Medical Research Facility, Maryland

Analyzed claims on behalf of the owner of a medical research facility. Performed schedule delay analysis and review of contractor’s damages claims.

Residence for the Ambassador of Spain, Washington, DC

Prepared claims on behalf of the contractor, who was impacted by delays and disruption resulting from continual owner scope changes and other issues. Performed schedule delay analysis and quantified damages. Presented at and participated in a mediation setting in Washington, DC.

Steelmaking Plant, Alabama

Team leader for a major quantum and disruption dispute on a $250 million USD steel plant in Alabama. Performed cost variance analysis to quantify cost overruns resulting from delay, disruption, and acceleration of works. Prepared expert report of cost analysis for court trial.

Steelmaking Plant, Brazil

Onsite project manager/team leader for two years providing risk and claims management services. Effective coordination and client management in a multinational cultural environment. Coordinated with the client’s executive management and legal advisors on critical claims issues. Performed independent analysis of the plant’s master schedule to project the realistic completion date. Engaged as delay and quantum expert to testify on delays and quantum for piling/civil works dispute of $50 million USD. Provided expert testimony in Brazil-Canada Chamber of Commerce in Rio de Janeiro, Brazil.

CHEMICAL & PETROCHEMICAL

Petrochemical Refinery Complex, India

Worked in the commercial department of an international structural steel contractor in Dubai performing quantity surveying tasks of payment applications and certifications, approving billing payments for subcontractors, pricing variations, and performing contract administration in accordance with FIDIC form of contract. Assisted commercial and finance manager in preparing commercial valuation reports. Had an active role in coordinating with the Italian client in payment certifications approval.

Schedule delay and causation analysis for a domestic arbitration in Delhi, India. Coordinated with senior management and counsel to prepare an expert report for delay and quantum.

Supported the delay expert in schedule delay and issue analysis. Evaluated the contractor’s change order estimate submissions.

Supported the delay expert in schedule delay analysis related to claims submitted by the contractor in arbitration. Analyzed various subcontractors’ manpower trends and assisted in the preparation of the daily specific as-built schedule.

Quantified financial damages for the new Dubai Metro Rail (Red Line) for $2.5 billion USD projects on behalf of a joint venture of international contractors. Main tasks involved review of the contractor’s budget estimates/revisions and cost forecast report, as well as performing transaction testing of labor, materials, equipment, MEP, and subcontractor works.

Performed damages analysis on behalf of the owner to assess various claims submitted by the contractor. Reviewed contractor’s delay and cost claims and backup substantiation and performed rebuttal using internationally accepted methodologies. Drafted damages report for mediation purposes.

Analyzed damages on behalf of the owner due to delays to a coal-fired thermal power plant in southern India. Drafted report on findings and potential risks of contractor’s claims.

Combined Cycle Power Plant, Midwest USA

Performed disruption and damages analysis on behalf of contractor for preparation of claims for a combined cycle power plant. Drafted damages report for mediation purposes.

Gas Turbine Power Plants, Oman

Expert witness for quantum issues due to delay and disruption to two power plants in Oman. Sole party arbitration in Delhi, India. Sat for expert testimony and cross examination in front of the ex-Chief Justice of the Supreme Court of India.

Performed delay analysis and renegotiations of solar power contracts, extension of time claims, and liquidated damages defense on behalf of an international contractor against a private owner entity. Issues involved supply chain disruption and impeding delays to the project.
